Presentation Summary

In 2023 and 2024, our Canadian courts considered a number of construction cases and disputes. We critically considered these cases and are pleased to present a
retrospective to share our insight and help construction professionals successfully operate in a risk-prone industry.
Attendees will learn about the key findings, principles and developments in construction claims and case law over the last few years.

Learning Objectives

What are the timelines to file a lien in the absence of a head contract? Do funds paid into trust as security for a lien constitute a payment under the parties’ contract to satisfy payment obligations or end accumulation of contractual interest? If an owner agrees to pay amounts owed by a contractor to its subcontractors to avoid lien claims being filed, how does that affect the owner's right to pay the holdback into court to discharge lien claims?

  •  Construction Defects — What is the liability of developers to subsequent purchasers? Does a strata corporation have standing to bring a representative statutory cause of action on behalf of the owners for misrepresentations in a disclosure statement given to purchasers of a unit? When is it reasonable for owners to delay undertaking remediation work until liability is determined?
